These Terms sit under each member's own membership agreement. If the two ever differ, the membership agreement for that plan wins.
Staffed hours: Monday to Friday 8am to 8pm; Saturday and Sunday 8am to 2pm (Monday to Friday 8am to 8pm; Saturday and Sunday 8am to 2pm). Gym access is 24/7 for adult members and approved 16 and 17 year olds. Saunas and sunbeds run in staffed hours only.
Vibes Gym and Vibes Studio ("we", "us") are trading names of Vibes Gym, company number , registered in England and Wales. "You" means the member, visitor, trial user, pass holder, personal training client, sunbed user, guest, or the parent or guardian of a junior member, as applies.
These Terms apply to everyone who joins, visits, buys from us or uses our facilities, website or app, and to parents or guardians who allow a junior to use them. They include: 1 General; 2 Membership; 3 Fees, charges and enforcement; 4 Using the gym; 5 Gym rules and conduct; 6 Juniors; 7 Member Health Pledge; 8 Lockers and belongings; 9 Waiver, risk and liability; 10 Passes; 11 Promotions; 12 Events; 13 Shop; 14 Your data and messages; 15 Vibes Studio sessions; 16 Law.
1. General
1.1 Accepting these Terms. When you join in the Vibes app, on our website, at the desk, on a paper form or (for members still billed through ClubRight) in ClubRight, you confirm you have read and agree to these Terms. Your tick, electronic signature, payment, pass purchase or first entry to the gym is binding acceptance (Electronic Communications Act 2000).
1.2 When the contract starts. You choose your start date when you buy a membership or pass, and your agreement shows it alongside the date you signed. A contract is formed at the first of: completing registration, ticking an acceptance box, signing, making a payment, buying a pass or service, or first entering the gym with your app pass or membership number.
1.3 Records we keep as evidence. Signing records (date, time, IP address, device and how you logged in), payment records, door entry logs, app and booking records, CCTV, and emails or messages with us may be used as evidence of what you agreed to, your use of the gym, access, rule breaches and acount activity.
1.4 Messages and your aacount. We send notices by email, app notice, text or WhatsApp to the details on your aacount. Keep your email, mobile and payment card up to date. Not receiving, opening or reading a message does not change what you have agreed.
1.5 Changes to these Terms and to memberships. We may change membership types, prices, features, access rules, services, products, opening arrangements or benefits. How a change reaches you depends on what it is:
- Most changes only apply to people who join or rejoin after the change. Your agreement stays as you signed it.
- Price changes: we tell you by email and in the app at least 30 days before the new price applies. You can cancel before then without any charge.
- Other changes that affect what you pay, your aacess or your rights: we tell you by email and in the app at least 30 days before, show you exactly what is changing, and sk you to accept it in the app. If you do not want it, you can cancel before it applies without any charge. If you carry on after that date, the change applies to you.
- Changes needed for safety or by law can apply sooner. We tell you as soon as we can, and you can still cancel without any charge.
- Changes that only fix wording, or are in your favour, can apply straight away.
Every version is dated and kept. When you accept a change in the app, it is added to your agreement as a signed change, so your agreement always shows what you first signed, every change since, and the agreement as it stands today. You can download it at any time. The current version is always in the app and at vibesgym.com/terms-and-conditions.
1.6 Existing members moving to these Terms. If you were already a member before you signed these Terms, however long ago you joined, your agreement shows the start date of your current membership as it is on our records, and your payment date, price and card stay the same. No setup fee is charged and there is no new cooling off period, because your membership carries on. These Terms apply from the date you sign them. Nothing in them applies to anything that happened before that date, and any fee in them that you were not charged before only applies from then.
1.7 Photos, filming and CCTV.
- CCTV runs throughout the premises, apart from changing rooms, toilets, sunbed rooms and the sauna, for safety, security, accident and complaint review, access control and enforcing these Terms. It is kept for up to 30 days unless we need it for an incident, claim or legal reason. It is never used for marketing.
- We take photos and video in the gym and studio to promote Vibes Gym and Vibes Studio on our website, social media, printed material and adverts, ourselves or through photographers working for us. We do this under our legitimate interest in promoting our business, as explained in our privacy notice. You may appear in these, including in the background of wide shots. We never film in changing rooms, toilets, sunbed rooms or the sauna.
- We tell members in the app before a planned photo or video shoot.
- Your right to object: you can sk us not to include you, at any time, in the app, at the desk or by email to hello@vibesgym.com. No reason is needed. We will keep you out of shots where we reasonably can nd remove or edit anything on our own pages that you are recognisable in within 14 days of you telling us. We cannot recall printed material already given out or adverts that have finished.
- We sk for written permission before using anyone in an advert we pay to run or in printed material where they are the main focus, and before publishing an identifiable photo or video of anyone under 18 (from their parent or guardian). We never name or tag anyone under 18.
- Commercial photography and filming at Vibes Gym, including by personal trainers, content creators, brands and photographers, needs our written permission first. Anyone we give permission to agrees that Vibes Gym owns the copyright in what they shoot here, or may use it freely for any purpose if we agree otherwise in writing.
- If you post photos or video taken at Vibes Gym and tag us or use our name, you allow us to reshare it on our own pages, with credit to you, free of charge. If you sk us to take a reshare down, we will.
- You must not film or photograph other members or staff in a way that invades their privacy, causes distress, captures changing areas, sunbed rooms or private conversations, or targets someone without their permission. If someone sks you to stop filming them, stop straight away. Filming in changing rooms, toilets or sunbed rooms ends your membership.
2. Membership
2.1 Memberships and variations.
- We offer no contract full access, off peak, off peak plus, concessions (students, Blue Light, Armed Forces and seniors), local business, couples, employee benefit (Epassi, MyGym, MyWellbeing, Gymflex), junior, Vibes Studio, tanning, friends and family, promotional and other memberships. All are covered by these Terms. Each one's details are in your membership agreement and on the live list of plans.
- Monthly memberships are rolling and paid in advance by the card you keep on file. Members still billed through ClubRight may pay by card or Direct Debit until we move them over.
- No contract means no tie in beyond the month you have paid for, unless your offer states a minimum period. A minimum period is always shown before you buy and in your agreement.
- Memberships, passes and services are personal to you. They must not be shared, transferred, sold, lent or used by anyone else unless we agree in writing.
2.2 Payments.
- Payments are taken automatically on your payment date from the card you keep on file.
- If a payment fails, your aacess is paused the same day and we tell you in the app and by email. If it is still unpaid 7 days after it was due, a late fee of is added. If it is still unpaid 14 days after it was due, an admin fee of is added and your membership is cancelled. We warn you 2 days before each of these. The missed payment and both fees stay owed, and you cannot use the gym, buy from us or rejoin until everything is paid.
- Removing your card, cancelling a Direct Debit or deleting your payment details does not cancel your membership. Any money owed becomes due straight away.
- If you raise a chargeback or payment dispute without talking to us first, we may pause your membership nd recover our reasonable costs. We will share your signed agreement and your payment and entry records with your bank.
- We may pass unpaid money to a debt recovery agency or make a claim through the courts, which can lead to a County Court Judgment. Reasonable recovery costs may be added.
2.3 Setup and joining fees. A setup fee of applies to the plans that show it, per membership bought. It is taken when you join and is not refunded once the 14 day cooling off period has passed, even if you later change plan, cancel or do not attend. Cancelling and rejoining, or rejoining under a different offer, does not avoid it. Moving to another plan while your membership carries on does not charge it again. Splitting a Couples membership into 2 single memberships does not charge it.
2.4 Who can have a discounted price, and proof.
- Corporate memberships are by approval. Ask us.
- Local business membership is for people working for a business on our approved list and may need proof.
- Concession, student, Blue Light, Armed Forces, senior, employee benefit and couples memberships may need proof, at signup or at any later time. Students are checked again every year.
- Couples memberships are only valid while both linked members meet the eligibility and stay on the Couples membership.
- If proof is not given when we sk, or you no longer qualify, we tell you 30 days before your price moves to the standard price for your membership. You can cancel without charge in that time. Giving false information can lead to your membership being cancelled.
2.5 Annual Gym Enhancement Fee. Members holding a gym membership that includes it pay a Gym Enhancement Fee of £30 on 1 October each year, as a contribution to equipment, maintenance and improvements. Full rules are in your membership agreement, including that it is due while frozen and if your end date is on or after that day, is not refunded, is taken once a year per person, and is not charged on sunbed only, Tanita, Friends and Family or studio only memberships, prepaid passes or class packs. We give at least 30 days notice of any change to the amount.
2.6 Freezing.
- You can freeze for 1 to 12 months, in the Vibes app, at the desk, or at vibesgym.com/cancel while you are still billed through ClubRight.
- On each payment date while frozen, a freeze fee of £10 is taken instead of your membership payment.
- A freeze starts on the date we confirm, cannot be backdated, and ends automatically. Your payment date does not change, and the first payment after the freeze is your normal price.
- There is no gym, studio or sunbed aacess while frozen.
- To come back early, pay a top up for the rest of that month (your monthly price less the freeze fee, for the days left). Access returns once it is paid.
- You cannot change plan while frozen, and frozen time does not count towards any minimum period.
- The Gym Enhancement Fee is still due on 1 October if you are frozen that day.
2.7 Cancelling.
- Cancel in the Vibes app or at the desk. Members still billed through ClubRight use vibesgym.com/cancel until we tell them they have moved.
- We sk for a reason and a short line of honest feedback. We will always cancel when sked and we will not be offended.
- Cancel before your next payment date if you do not want that payment taken. Your membership ends at 11.59pm the day before that payment date. A payment already queued by your card provider may still be taken; if it is, and it falls after your end date, we refund it.
- If you cancel on a payment date, that payment is still taken.
- We confirm your end date by email. Not going to the gym, moving away, injury, illness, work, deleting your card, cancelling a bank mandate or messaging a member of staff informally does not cancel your membership.
- Payments already taken are for time already started and are not normally refunded. You can use the gym until your end date unless your membership is suspended or ended for a breach.
- If your membership has a minimum period, payments carry on until it ends.
- Class credits, tanning minutes and other prepaid balances have no cash value when you leave.
- Couples: if you split up, either of you can press "Split into 2 single memberships" in the app (Profile, Membership) or ask at the desk. You each move to No Contract Full Access at its price at that time, with no setup fee. Your payment date stays the same. For the rest of the current month you each pay the difference between your share of the Couples price and the single price, and from then on you each pay your own membership nd your own Gym Enhancement Fee. We show you the new amounts and dates before you confirm.
2.8 Your right to cancel (cooling off). For monthly memberships bought online, in the app or by phone, you can cancel within 14 days. We offer the same on monthly memberships bought at the desk. You pay a fair share for the days you have used, and any setup fee is refunded unless it paid for something already done for you. Prepaid passes have no cooling off period (section 10).
2.9 Prepaid passes. See section 10.
2.10 Moving up an age band. Junior memberships move to the next age band, and to an adult membership t 18, on the first payment date on or after the birthday, at that plan's price, with no setup fee. We tell the member, and the parent or guardian, at least 30 days before.
3. Fees, charges and enforcement
3.1 Charges for rule breaches. Some breaches create extra staff time, cleaning, admin, safety risk, CCTV review, damage or disruption. Charges for them form part of these Terms and may be added to your aacount. We tell you about any charge in the app and by email with the reason and the evidence, and how to dispute it.
3.2 Re racking fee: £20.
- Every plate, dumbbell, bar, attachment, kettlebell, handle, clip, collar and acessory has a set place and must go back exactly where it belongs straight after use. Leaving kit nearby, on the wrong rack, on a random machine, on the floor, or loaded on a machine, bench, bar, rack or cable station counts as not re racking.
- If you load a machine, bench, bar, rack, plate loaded machine or cable station, you unload it fully and put every item back on its correct peg, rack, stand or holder.
- The first time, you get a warning (a strike) in the app and by email. From the second incident within 6 months, the re racking fee may be charged for each incident seen by staff or on CCTV. Repeat offences can lead to suspension, cancellation or permanent removal of aacess.
3.3 Sharing access, tailgating and trespass: £62.99 each time.
- Your app pass, QR code and membership number are for you only. Tailgating, holding the door for anyone, sharing your pass or membership number, letting anyone in with you, or letting anyone else use your membership is not allowed. Your app works on 1 phone at a time; signing in on another phone signs the first one out.
- When we see it (on CCTV, in the door records or in person), this happens:
- First time: a trespass fee of £62.99 is added to your aacount and taken from the card you keep on file, your aacess is paused until it is paid, and you get a strike. We email you the reason and the evidence.
- Second time within 12 months: another £62.99 fee, and your membership is cancelled with no refund. You cannot rejoin for 12 months.
- Selling or renting out access, letting in someone we have banned, or deliberate repeated sharing: your membership is cancelled straight away with no refund, and you may be banned permanently.
- The person let in is charged the same fee if we can identify them, and may be banned.
- We may also take civil action to recover our losses.
- If you think we have got it wrong, tell us within 14 days and we will look at the evidence again. If we agree, we refund the fee nd remove the strike.
3.4 Damage, misuse and cleaning charges.
- We may charge for damage caused by misuse, careless or deliberate damage, not following instructions or not using equipment safely.
- We may charge reasonable cleaning, repair, replacement, call out or admin costs where your aations cause damage, mess, contamination, disruption or extra work for staff or contractors.
- This includes machines, benches, upholstery, flooring, mirrors, doors, lockers, door and acess equipment, changing rooms, toilets, saunas, sunbeds, accessories and fixtures.
3.5 Paying charges. Charges added under these Terms are payable straight away, from your saved card, by a secure link we send you, or with your next payment. Access may be paused until any membership balance, missed payment, late fee, admin fee, re racking fee, trespass fee, damage charge, cleaning charge or other valid balance is paid.
3.6 Enforcement and evidence. Action may be based on staff observation, member reports, entry logs, CCTV, payment records, written complaints, photos or video. We may give strikes and warnings, charge fees, pause or restrict access, cancel a membership or ban someone permanently for rule breaches, unsafe behaviour, acess misuse or non payment. Strikes: a first strike is a warning in the app and by email; a second within 6 months pauses acess for 7 days; a third within 6 months may end your membership. Serious incidents, tailgating and acess sharing can lead straight to cancellation.
4. Using the gym
4.1 Access, safety and health.
- Vibes Gym is open 24/7. Outside staffed hours nobody from Vibes Gym is on site and you train entirely at your own risk.
- You get in with the rotating QR pass in the Vibes app (it changes every 30 seconds and works on 1 phone at a time) or your membership number. Members still on ClubRight may also use the ClubRight app. Never share them.
- Your acess stays locked until your agreement, health questions, photo nd required details are complete.
- There is no on site emergency alarm. In an emergency call 999 and, if needed, leave the gym to get help. CCTV runs at all times.
- By coming in you confirm you are fit to exercise and accept the normal risks of training (section 9), and you agree to the Member Health Pledge (section 7).
- If you are not sure how to use any equipment, do not guess. Ask staff during staffed hours first.
- Put all equipment back in its set place after use (section 3.2).
4.2 Non members and trespass. Only people with an active membership or pass, using their own app pass or membership number, may come in. Helping anyone else in is not allowed and can lead to the trespass fee in section 3.3, permanent cancellation and civil action.
4.3 When we can refuse entry. The door may refuse or pause entry outside your membership's hours, while frozen, cancelled or expired, while a payment is overdue, while required details are missing, or when acess has been paused for a breach. A refusal for any of these reasons does not entitle you to a refund. The door can take up to 5 minutes to update after a payment or a change.
4.4 Saunas and sunbeds.
- Saunas and sunbeds run in staffed hours only.
- Saunas are in the separate male and female changing rooms. They are not unisex. Sit on a towel, keep conversation respectful, do not shave, do not use oils, do not bring glass in, and follow the sauna rules on display. Under 16s may not use the sauna. 16 and 17 year olds may, with parent or guardian consent.
- Sunbeds are strictly 18 and over, and nobody under 18 may go into or wait in a sunbed room, including members' own children. We check photo ID before your first session. 1 person in a sunbed room at a time.
- You do not need to be a gym member to use the sunbeds. Tanning is paid for separately and covered by the sunbed waiver.
- Monthly tanning plans allow a session of up to 9 or 12 minutes in any 24 hours, as stated on the plan. Pay as you go minutes can be bought at £1.50 a minute, by members and non members, if staff approve. Bought minutes last 200 days.
- Sunbeds run in staffed hours only and are started for you by a member of staff.
- Your sunbed sessions and minutes are for you only. Letting anyone else use them, above all anyone under 18, ends your tanning use and may end your membership.
- Eye protection must be worn. All sunbed use is covered by the sunbed waiver, age checks and staff authorisation.
4.5 Ending a membership for a breach. We may suspend or cancel any membership for breach of these Terms, non payment, misuse of the facilities, unsafe or abusive behaviour, acess misuse, damage, repeated rule breaches, or behaviour we reasonably consider harmful to members, staff or the gym. No refund is due for the remaining time.
5. Gym rules and conduct
The gym rules (signed in the app as Template 5) are this section, word for word.
5.1 Access and entry.
- 24/7 aacess. Staffed hours Monday to Friday 8am to 8pm; Saturday and Sunday 8am to 2pm. Outside staffed hours you train at your own risk.
- Use your own app pass or membership number. Do not share aacess or let anyone tailgate. A breach can mean immediate suspension or cancellation.
- CCTV runs throughout. There is no on site emergency alarm. In an emergency call 999 and, if needed, leave the gym to get help.
- Under 18s train only under section 6.
5.2 Respect and conduct.
- Respect staff and members. No rudeness, aggression, bullying, intimidation, harassment, discrimination or anti social behaviour.
- Be considerate with noise, language, filming and behaviour.
- No filming or photos of others without their consent. Stop straight away if sked.
- Do not sit on equipment scrolling your phone when others are waiting. Staff may ask you to move on or share. Repeated issues can lead to suspension or cancellation.
- No illegal activity. Offenders may be reported to the police and banned permanently.
- No alcohol, drugs or performance enhancing drugs on the premises, and no selling or supplying anything.
- No smoking or vaping anywhere on the premises.
5.3 Hygiene.
- Keep good personal hygiene: clean clothing, deodorant and regular showering. Anyone with poor hygiene may be asked to leave until it is sorted.
- Bring a towel, lay it on benches and mats where practical, and wipe equipment down after use.
- No spitting. No chewing gum anywhere in the gym. Gum goes in a bin, never on floors, equipment or in urinals.
- No shaving in the showers or the sauna.
- Do not put on oils, creams, tanning products, strong fragrance or anything else that marks, stains or damages equipment.
5.4 Dress code and footwear.
- Clean, indoor only trainers. No muddy footwear or work boots.
- No jeans. No sliders, flip flops, sandals, Crocs or open toe footwear on the gym floor.
- Barefoot training only if management agree in writing for a specific exercise or rehab. In the studio, follow the instructor.
- Clothing must be suitable and safe for training in a shared gym.
5.5 Equipment, bags and re racking.
- Use equipment only as intended and check it is safe before use. If unsure, ask staff in staffed hours.
- Re rack everything straight after use, exactly where it belongs (section 3.2: a warning first, then a £20 fee each time).
- Do not drop or throw weights unless you need to. Use clips or collars and control the load.
- No bags or coats on the gym floor. Use the lockers so walkways stay clear.
- Report damaged or faulty kit in the app, at the desk or to hello@vibesgym.com, and stop using it straight away.
- Damage from misuse may be charged (section 3.4).
5.6 Lockers, changing rooms and belongings. See section 8. Keep changing rooms tidy; unattended items may be removed.
5.7 Children nd reception.
- Children under 11 may wait in reception only while their parent or guardian trains, as long as there is no obstruction, disruption or safety issue.
- Children must not go onto the gym floor, training areas or changing rooms unless they are a junior member training under section 6.
- Staff do not supervise children. Parents nd guardians are responsible for their children t all times.
5.8 Saunas and sunbeds. As section 4.4. Sunbed use is refused until photo ID has been checked, if safety guidance is not followed, or if staff have any safety concern.
5.9 Guests, trials and tailgating.
- No bringing non members in without authorisation (trespass fee, section 3.3).
- Misusing 24/7 aacess, tailgating or letting anyone in can lead to permanent removal of aacess and cancellation.
- Guest passes, free trials, complimentary and promotional visits must be issued and logged before use. They cannot be assumed, backdated or claimed after entry unless we agree.
5.10 Enforcement.
- Strikes, fees, pauses, cancellation or bans may follow rule breaches, unsafe behaviour or non payment (section 3.6).
- In unstaffed hours, at responsibly, stay alert to safety and report hazards as soon as you can.
- Repeated small issues can be treated as a serious breach when they show disregard for the gym, staff or members.
5.11 CCTV. CCTV runs throughout the premises. Recordings may be reviewed for accidents, complaints, acess misuse, damage, theft, trespass, rule breaches and safety concerns, including re racking, tailgating, acess sharing and misuse of equipment.
6. Juniors (11 to 17)
6.1 Minimum age and consent. The minimum age for the gym floor is 11. Every 11 to 17 year old needs their parent or legal guardian to sign the membership agreement and the agreement for their age group before the first session. These are sent to the parent's phone to sign. We may sk for photo ID for the junior and the parent or guardian.
6.2 Age groups.
- 11 to 13: always train with a parent, guardian or named responsible adult who is an active paying member, 1 to 1, for the whole visit, never alone.
- 14 and 15: may train alone in junior hours once they have had an induction and consent is in place. Outside junior hours, only with a responsible adult who is an active paying member, has scanned in with their own app pass or membership number, and stays for the whole visit.
- 16 and 17: may train alone once induction and consent are complete, including 24/7 once their parent or guardian has signed the 16 to 17 agreement. We may limit them to staffed hours, or suspend aacess, if consent or induction is missing, rules are broken or we have safety concerns.
6.3 Junior hours. Monday to Friday 8am to 5:30pm, last entry 4:30pm. Saturday and Sunday 10am to 2pm, last entry 1pm. A junior under 16 found in the gym outside junior hours without a responsible adult member may have their acess paused until we have spoken with them and their parent or guardian. Juniors must not use someone else's pass, tailgate, or ask members to let them in and leave them.
6.4 Saunas and sunbeds for juniors. Under 16s may not use saunas. 16 and 17 year olds may in staffed hours with parent or guardian consent. Sunbeds are strictly 18 and over, and under 18s must not go into the sunbed rooms; agreeing to these Terms as an under 18 never gives permission to use them.
6.5 Parents nd guardians. The parent or guardian is responsible for the junior's payments (including when the junior pays with their own card), their behaviour, supervision where required, and making sure they understand and follow these Terms, including sections 3, 5, 7 and 9. A responsible adult who trains with a junior must stay present and attentive for the whole visit. We cont at the parent or guardian about the junior's membership, access, safety, rule breaches and changes to junior rules or hours; this is a service message, not marketing.
7. Member Health Pledge
This Pledge forms part of your membership agreement, with these Terms, the gym rules and the waiver. By joining or using the gym you confirm you have read, understood and agree to it. It is also shown in the app and at vibesgym.com/member-health-pledge.
7.1 Health and safety.
- The health information you give us, including your answers to our health questions, is true, complete and up to date to the best of your knowledge, and we may rely on it.
- If you have a medical condition or injury, are pregnant or post partum, are recovering from surgery, or take medication that could affect exercise, you will get medical advice before training and follow it.
- If you answer yes to a health question, or your health changes, you will get medical advice before exercising, tell us, and update your answers in the app when we sk. We may sk for a note from your GP before you train.
- You will stop straight away nd get help if you feel unwell, dizzy, faint, in pain, unusually short of breath, light headed, or have chest pain, severe discomfort or anything that feels abnormal.
- You will train within your limits, build up gradually and use equipment safely and as intended, and sk staff in staffed hours if you are unsure.
- Our staff are not doctors and cannot give medical clearance. That stays your responsibility.
7.2 Hygiene and conduct. Keep good hygiene, bring a clean towel and use it on cont at surfaces, wipe down kit, wear clean indoor only trainers and suitable clothing, keep bags and coats in lockers and walkways clear, and follow posted notices and reasonable staff instructions (section 5).
7.3 Shared space and respect. Re rack straight after use and never leave bars or machines loaded. Treat everyone with respect. No smoking or vaping. You train at your own risk, especially in unstaffed hours. Under 18s follow section 6. Children under 11 may stay in reception only.
7.4 Saunas and sunbeds. Saunas in staffed hours and in line with age rules and posted rules. Sunbeds 18 and over, staffed hours, with staff authorisation, after accepting the sunbed waiver; wear eye protection, follow the exposure guidance, and stop if you have redness, irritation or any reaction.
7.5 Health or safety concern? Email hello@vibesgym.com or speak to staff in staffed hours.
8. Lockers and belongings
- Lockers are shared, not personal. Use one only while you are in the gym, bring your own padlock, and empty the locker and take your padlock off before you leave.
- Nothing can be left in a locker overnight. Any padlock left on a locker overnight will be cut off and the contents removed. Contents are kept for 7 days, then donated or destroyed.
- Lost property found anywhere else is kept for 7 days, then donated or destroyed.
- Do not leave valuables unattended.
- We are not responsible for loss, theft or damage to belongings, or for removing or disposing of items under this section, except where caused by our negligence.
9. Waiver, risk and liability
9.1 Risk you accept. Exercise and the use of gym equipment, free weights, machines, cardio nd functional kit, changing rooms, saunas and sunbeds carry risks, including strains, sprains, slips, trips, falls, impact injuries, overexertion, equipment misuse or failure, burns, dehydration, fainting and skin irritation. You accept these risks, except where caused by our negligence.
9.2 Health declaration. You confirm you are fit to exercise and will train within your limits. If you re pregnant or post partum, injured, on medication, recovering from surgery, have a medical condition, have been told not to exercise, or have anything that could affect safe training, you have spoken to a qualified health professional and will follow their advice.
9.3 Unstaffed training. Outside staffed hours the gym is unstaffed. You are responsible for training safely, using equipment properly, not going beyond your ability, and calling 999 in an emergency. There is no on site emergency alarm.
9.4 Liability. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your legal rights as a consumer are not affected. Otherwise, Vibes Gym and its staff, contractors and representatives are not liable for: (a) losses from risks you have accepted; (b) loss of or damage to belongings; (c) indirect or consequential losses; or (d) injury or loss caused by your misuse of equipment, not following the rules, not getting medical advice, or unsafe conduct.
9.5 Your responsibility for costs. You agree to cover our reasonable costs arising from: (a) damage you cause by misuse, negligence or deliberate conduct; (b) claims from others caused by your breach of these Terms or unsafe conduct; or (c) unauthorised entry you caused or allowed. This does not apply where we are at fault.
9.6 Under 18s. For a member under 18, the parent or guardian accepts this waiver and is responsible for the young person's behaviour, supervision where required, safe use of the gym and following these Terms.
9.7 Sunbeds. The sunbed waiver is a separate form signed before the first session. In short: 18 and over only, photo ID checked before the first session, sessions are for the member only, giving a false age can end your tanning use and membership, staffed hours only and started by staff, UV light can cause skin ageing, burns, eye injury and skin cancer, some medicines (including some antibiotics, ane treatments nd antihistamines) and some lotions, oils, cosmetics and perfumes raise sensitivity, eye protection every time (we are not liable for eye damage from not wearing it, except where the law says we are), think about your skin type (very fair skin that burns and does not tan should not use a sunbed), watch how your skin reacts and shorten sessions if it reddens, never go over the bed's maximum session time, 1 session in any 24 hours with 48 hours advised, and staff may refuse or stop sunbed use for safety, suspected overexposure, skin reactions, intoxication, not following instructions or no age check.
10. Passes
- We offer 1 Day, 1 Week, 1 Month, 3 Month, 6 Month and 12 Month passes, concession passes, a Gymflex / Epassi 1 Year Pass, a Sauna Only Pass and prepaid tanning passes.
- Passes are paid in full in advance and cover the set period only, starting on the date fixed when you buy. There is no Gym Enhancement Fee on passes.
- Passes are non refundable, non transferable and cannot be cancelled once bought. There is no 14 day cooling off period, because they are leisure services for a set period. They end automatically.
- ID may be requested on your first visit.
- You sign the pass agreement the first time you buy a type of pass. When you buy the same type again it covers the new pass, unless we have changed it, in which case we show you what changed and sk you to accept it first. We sk you to sign again every 12 months. Every purchase is confirmed by email with the dates and price.
- Passes are covered by these Terms, including sections 3, 5, 7, 8 and 9. Under 18s using a pass follow section 6, and parent or guardian must sign before first use.
- Saunas run in staffed hours only. Sunbeds are 18 and over, staffed hours only.
- Complimentary, trial and promotional passes must be issued and logged before use. They cannot be transferred, sold or claimed after the event unless we agree.
11. Promotions
- Offers are for a limited time, subject to availability, and may be withdrawn or changed at any time. This does not change an offer you have already signed up to.
- Who can have an offer is stated when it is offered.
- Unless stated otherwise, offers cannot be combined with other discounts nd are non transferable and non refundable.
- Where an offer gives a reduced first month, free period, reduced or no setup fee, fixed price period or other limited benefit, your membership then carries on at the standard price unless you cancel in line with these Terms. The price you will pay afterwards is shown before you buy.
- Some offers need a minimum commitment, for example 1 full paid month. This is shown in the offer and at checkout.
- Offer prices do not apply when you switch plans.
- We may check eligibility and refuse or remove an offer for misuse, false information, duplicate use or breach of these Terms.
12. Events
From time to time we run in gym promotions, tutorials, workshops, charity events, member events, partner led activities and filming.
- You may need to register. Places are first come, first served where limited.
- Follow staff instructions, safety guidance and these Terms, including sections 5, 7 and 9.
- We may photograph or film events for marketing. If you do not want to appear, tell staff on the day and we will work around you where we reasonably can.
- We may refuse participation for safety, capacity, rule breaches or inappropriate behaviour.
- We may change or cancel events for operational reasons, with reasonable notice where practical. If you paid for an event we cancel, we refund you.
13. Shop and products
- Products and prices are in the app shop, at vibesgym.com/shop and at the desk. Availability, prices and collection options may change.
- Online orders are collected from reception in staffed hours. For goods bought online or in the app you can cancel within 14 days of collection for unopened, unused goods, except sealed health and hygiene items once opened, food and drink, and personalised items, where the law allows. Faulty goods are covered by the Consumer Rights Act 2015.
- Refunds go back the way you paid.
- Gift cards work like cash for whoever holds them, can be used at the till, and expire 24 months after purchase. Store credit has no cash value and expires 12 months after it is issued. Neither can pay for memberships.
14. Your data and messages
- We use your personal data to run your membership, as set out in our privacy notice at vibesgym.com/legal: your details, photo, payments, door entries, bookings, health answers, call recordings and CCTV.
- Your card is held by Stripe, not by us.
- Service messages (payments, access, bookings, safety, changes to your membership) are sent by email, app, text or WhatsApp and are not marketing. Marketing is only sent if you opt in, and you can stop it at any time. Opt in boxes are never pre ticked.
- Calls to the gym may be answered by our automated receptionist, and are recorded and transcribed.
- Decisions such as door aacess and fees are made by our system from these Terms. You can sk staff to review any automatic decision.
15. Vibes Studio sessions and session credits
15.1 Where and who. Vibes Studio is at 3e St Francis Way, Shefford. Your instructor lets you in for each session; do not let anyone else in. Studio only memberships and session credits do not include the gym. Under 18s follow the age rules for each session type shown when booking (16 and 17 year olds can book on their own; 11 to 15 year olds only when a parent or guardian is booked into the same session.).
15.2 What this covers. These rules apply to every way of doing studio sessions: pay as you go single sessions, session packs (including Intro 3), studio memberships such as Vibes Studio 8, and gym memberships that include sessions such as Vibes Complete.
15.3a Credits.
- A session credit pays for 1 place in 1 session. Credits come from a studio membership (renewing each payment date; unused ones do not carry over) or from a pack or single session you buy.
- Credits are personal to you and cannot be used by anyone else, including family.
- Pack credits last for the period shown when you buy them (Intro 3 credits last 21 days, 5 packs 60 days and 10 packs 90 days from the day you buy them.). Credits do not run out while your membership is frozen.
- Credits have no cash value and are not refunded when you leave, except under the cooling off rules below.
15.3 Booking.
- Book in the app or online, up to 14 days ahead. Booking closes 2 hours before the start.
- Sessions are capped at 12 people, Vibes Ride at 8.
- If a session is full you can join the waiting list. If a place opens we book you in automatically, use a credit and tell you straight away.
- You cannot book while your membership is frozen, while a payment is overdue, while your agreement or health questions are not complete, or while a booking block is in place (15.6).
15.4 Cancelling or missing a session.
- You can cancel a booking in the app up to 12 hours before the start. When you cancel a booking yourself, the credit is used and does not come back, whenever you cancel. The app tells you this before you confirm.
- If our team removes you from a session, they decide whether to give the credit back. If our team moves you to nother session, it counts as the same booking and the credit stays used.
- If you do not turn up, the credit is used.
- If we cancel a session (for example the instructor is ill or too few people booked), your credit goes back to you, or you get a refund if you paid for that session on its own. We tell you in the app and by email as soon as we know.
- We may change the timetable, a session time or the instructor. If a session you booked changes, we tell you, and you can cancel it with your credit returned.
15.5 Arriving and taking part.
- Arrive in time to set up. For safety, you may not be able to join once the warm up has finished, usually 10 minutes after the start; the credit is then used.
- Tell your instructor before the session about any injury, condition or pregnancy, and follow their advice on changing exercises. Your instructor can see that you have a health note but not what it says.
- Follow the instructor. Work at your own level and stop straight away if you feel unwell, dizzy, faint or in pain.
- On Vibes Ride your instructor sets up your bike on your first ride. Do not change equipment settings you have not been shown.
- The instructor may stop you taking part, or ask you to leave, if they think it is unsafe, including if you seem unwell or under the influence of alcohol or drugs. The credit is then used, unless it was our mistake.
- Sessions are covered by these Terms, including the Health Pledge (section 7), the waiver (section 9) and photos and filming (section 1.7).
15.6 Booking blocks. If you miss 3 sessions without cancelling within 30 days, you cannot book for 7 days. We tell you in the app and by email when block starts and ends. If you think it is wrong, tell us and we will look again.
15.7 Cooling off on packs and single sessions.
- A single session booked for a set date and time has no 14 day cooling off period (leisure service for a set date, Consumer Contracts Regulations 2013 regulation 28).
- A pack of credits bought online or in the app is not for a set date, so you can cancel it within 14 days of buying. You pay for any sessions you have already used at the single session price and we refund the rest.
- Studio memberships follow the cooling off rules in your membership agreement.
15.8 Buying again. You sign the session agreement the first time you buy a pack, a single session or a studio membership. Later purchases of the same kind are added to it, as for passes (section 10).
16. Law
These Terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live in Scotland or Northern Ireland you can also bring a claim in your local courts.
